Historically, Japan’s approach to obviousness qualifications has differed from that of US prosecution. Likewise, European requirements for support tend to be unique. It it not surprising, then, that prosecution before the JPO proceeds more smoothly when claims have the preferred organization and structure, making it easier to reframe the invention for allowance, or to introduce limiting wording that doesn’t give up substantial matter with respect to the strategic part of the invention requiring protection.
